Terms of Service
These Terms of Service ("Terms") govern your access to and use of the PestLook platform (web application, Android mobile app, and any related services) operated by Umbrella Solutions LLC, PO Box 587, Bound Brook, NJ 08805, USA ("we", "us", "PestLook"). By creating an account or using PestLook, you agree to these Terms.
1. The service
PestLook is a pest scouting and trap monitoring platform that allows farmers, agronomists, and scouting teams to record field observations, manage traps, analyse pest trends, and generate intelligence reports. The platform is currently in public beta. Features, availability, and pricing may change during the beta period.
2. Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- Each organisation is a separate tenant. The admin of an organisation is responsible for the conduct of all users (scouts) within that organisation.
- You must be at least 18 years old to create an account.
3. Beta period
PestLook is currently offered free of charge while in beta. During this period:
- The platform may be updated, changed, or have features added or removed without prior notice.
- Planned downtime or unexpected outages may occur.
- We will provide advance notice before introducing any paid tier, and current beta users will not be switched to a paid plan without that notice.
- We make no guarantee of service continuity during the beta period, though we will make every reasonable effort to maintain availability.
4. Acceptable use
You agree not to:
- Use PestLook for any unlawful purpose or in violation of any applicable regulations.
- Attempt to gain unauthorised access to any other organisation's data, accounts, or systems.
- Interfere with or disrupt the platform's infrastructure, servers, or networks.
- Use automated scripts or bots to scrape or extract data from the platform without our prior written consent.
- Upload content that is illegal, harmful, defamatory, or infringes any third party's intellectual property rights.
- Resell or sublicense access to the platform without our prior written consent.
5. Your data
You retain ownership of all farm data, observations, photos, and operational data you submit to PestLook. By submitting data to the platform, you grant us a limited licence to store, process, and display that data solely for the purpose of providing the service to you.
We do not claim ownership of your data and will not use it for any purpose beyond operating and improving the platform. See our Privacy Policy for full details.
6. Intellectual property
The PestLook platform, including its software, design, algorithms, and intelligence models, is the property of Umbrella Solutions LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the platform without our prior written consent.
7. Disclaimers
PestLook is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The platform will be error-free or uninterrupted.
- Pest forecasts, threshold alerts, or intelligence outputs are 100% accurate or complete.
- The platform is suitable for any specific agricultural, regulatory, or commercial purpose.
Pest management decisions remain the responsibility of the farmer or agronomist. PestLook intelligence outputs are tools to support decision-making, not substitutes for professional agronomic advice.
8. Limitation of liability
To the maximum extent permitted by applicable law, Umbrella Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of crops, revenue, profits, or data, arising out of or in connection with your use of the platform, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to these Terms or your use of PestLook shall not exceed the amount you paid to us in the twelve months preceding the claim. During the free beta period this limit is USD $0, meaning we provide the service with no financial liability.
9. Termination
You may delete your account at any time by contacting us at admin@pestlook.com. We reserve the right to suspend or terminate your account without notice if you breach these Terms or engage in conduct that we determine to be harmful to the platform or other users.
Upon termination, your right to use the platform ceases immediately. We will handle your data as described in the Privacy Policy.
10. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Somerset County, New Jersey.
11. Changes to these Terms
We may update these Terms from time to time. We will notify registered users by email of material changes. Your continued use of PestLook after the effective date of any changes constitutes acceptance of the revised Terms.
